TERMS AND CONDITIONS

Our terms and conditions govern all purchases and installations from MyNewFloor.com. By engaging our services or making a purchase, you agree to adhere to these terms. They cover warranties, installation, payments, and dispute resolution. Review them carefully for a transparent and satisfactory flooring experience.

GENERAL TERMS

All Sales Are Final: No refunds or returns will be granted for any products or services. The 3D rendering deposit is non-refundable, as it covers the time, creative work, and resources dedicated to developing your custom design.

Arbitration: Any disputes between the Customer and Contractor shall be resolved through arbitration as governed by the American Arbitration Association. Both parties agree to adhere to the arbitration process upon receipt of a notice of intent to initiate arbitration.

Right to Lien: In cases of non-payment, Contractor reserves the right to file a mechanic’s lien against the Customer’s property to recover unpaid amounts for services, materials, or equipment provided.

Damages: Contractor is not liable for any property or furniture damage unless the issue is reported by the Customer while the installation team is present on-site. The Customer is responsible for inspecting the property, furniture, and appliances for damage during the installation process.

Furniture and Item Removal: Customers must remove all breakable items, clothing, hanging items, and electronic equipment before installation. Failure to comply may result in a $299 reschedule fee. Items such as pool tables, aquariums, safes, grand pianos, and grandfather clocks must also be prepared or removed by the Customer.

SERVICES NOT INCLUDED

Subfloor and Substrates: Subfloor and substrate preparation services are not included in the purchase order unless explicitly specified in the estimate. This includes, but is not limited to: Structural repairs, Leveling, Moisture mitigation, Reinforcement of existing sub-flooring. It is the Customer’s responsibility to ensure the subfloor or substrate is in proper condition to support flooring installation. Any issues identified must be addressed by a qualified professional before installation can proceed. Contractor assumes no liability for subfloor or substrate work performed by third parties.

Plumbing Services: Plumbing services are not included in the purchase order unless explicitly specified in the estimate. This includes, but is not limited to: Sink installation, Faucet adjustments, Water line connections, Valve or flange replacement, Garbage disposal or dishwasher installation. If plumbing services are not specified in the estimate, it’s the Customers responsibility to hire a plumber for any plumbing-related work. Contractor assumes no liability for plumbing services performed by third parties.

Painting Services: Painting services are not included in the purchase order unless explicitly specified in the estimate. This includes, but is not limited to: Painting of walls, ceilings, risers, moldings, or other areas. If painting services are not specified in the estimate, it’s the Customers responsibility to hire a professional painter to complete any painting requirements. Contractor assumes no liability for painting services performed by third parties.

Electrical Services: Electrical services are not included in the purchase order unless explicitly specified in the estimate. This includes, but is not limited to: Wiring or lighting installation, Outlet or switch installation, Appliance installations requiring electrical connections (e.g., ovens, cooktops, refrigerators, or dishwashers). If electrical services are not specified in the estimate, it’s the Customers responsibility to hire an electrician for any electrical work or appliance installations. Contractor assumes no liability for electrical work or installations performed by third parties.

Hardware Services: The supply and installation of hardware are not included in the purchase order unless explicitly specified in the estimate. This includes, but is not limited to: Handles, knobs, pulls, hinges, or specialty hardware. If hardware is not specified in the estimate, it is the Customer’s responsibility to supply and install the necessary items or request an updated estimate to include them. Contractor assumes no liability for hardware not included in the purchase order or installed by third parties.

Fixtures and Accessories: The supply and installation of fixtures and accessories are not included in the purchase order unless explicitly specified in the estimate. This includes, but is not limited to: Sink bowls, faucets, showerheads, shower trims, wall niches, dispensers, or similar items. If these items are not specified in the estimate, it is the Customer’s responsibility to provide and arrange for their installation. An updated estimate can be requested to include these items. Contractor assumes no liability for the supply or installation of fixtures and accessories not included in the purchase order.
